Prenuptial & Postnuptial Agreement

A prenuptial agreement is entered into prior to the marriage and it establishes guidelines for how assets and liabilities will be handled in the unlikely event of a divorce. Postnuptial agreements can also cover areas such as alimony. Prenuptial agreements are upheld in all 50 states, including the District of Columbia, provided that they are drafted in accordance with the law. Prenuptial agreements take precedence over marital property, divorce and probate laws. Postnuptial agreements address the same types of issues as prenuptial agreements and are also valid documents in a court of law, if done properly. The main difference is that a postnuptial agreement is entered into during the marriage as opposed to prior to marrying.
